Her name was Patience. Was she beautiful? No portraits or pictures exist, but she must have been a beautiful person. Was she rich? No records have been found to indicate that she owned land or property. She wasn't educated, as she signed her mark "V" but she had some sense as the court allowed her to administer her husband's estate and she was smart enough to leave a will. Only the winds of history know her name and her lineage, but her descendants are many.
It appears she was a young girl when she married and started a family; and with at least two small children, her husband died. About the time of the administration of his estate, she was wisked again into matrimony. Two more children were born when fate made her a widow again. Patience married once more to a man possibly ten years her junior (maybe she was beautiful). She raised her children to know their heritage and probably played a part to ensure they retained their father's properties. Patience had to endure the deaths of her children and apparently raised her grandchildren and even some of her great grandchildren....always a mother.
Living into her 80's, Patience survived her third husband and several of her children. The only thing she left as a clue was her will, where she named surviving children and grandchildren. From her will the leap is made that she was the wife of these three men and the mother of their children. Her descendants remained in Northampton and Accomack or carried the three surnames to early Worcester & Somerset, Maryland, Isle of Wight, Virginia, Delaware, Kentucky and possibly Indiana. For generations, her children and their children used particular family names (Rose, Margaret, Esme) and remembered her with daughters named Patience. This project originally began and started to come together based on the use by these families of the odd given name, Esme. With it's various spellings (Ismae, Ismay, Isma, Esme), it is probably a offshoot of the name Ishmael.
Comments, questions, additions and corrections are welcome. The researcher is warned that this lineage is not absolute and that some descendants are speculative or their connection is based on a minimum of evidence; all of which is noted. In many instances, information provided by fellow ghotes or other researchers is noted when that particular surname enters the line and not with each following generation.

And with great appreciation to the many Ghotes who have provided information, particularly M. K. Miles for some of the Fisher information, Bill Wilkins for his love of all things eastern shore and willingness to share and especially Jim Marshall for his intrigue with the given name Esme and passion for the surname Marshall. Many of Patience's descendants can be traced further through the Fisher and Northampton Marshall family journals.

1. Patience1 "V" (Fisher, Wainhouse, Marshall) was born about 1682. Patience died before November 8, 1768 in Northampton Co., VA.
She married three times. She married Thomas Fisher in Northampton Co., VA, about 1697. Thomas was born in Northampton Co., VA about 1664. Thomas was the son of Phillip Fisher (Capt.) and Elizabeth Maddux. Thomas died 1709 in Northampton Co., VA. In his will dated September 11, 1680, probate November 1, 1683, Edmund Kelley left a cow calf to Thomas, son of Thomas Maddox, and named godson Thomas, son of Phillip Fisher and left him a cow calf. (James H. Marshall, NH Wills & Adm.)
Patience was named administrator for his estate for herself and the children on May 28, 1709. (James H. Marshall, Wills & Admin. Northampton Co., VA, p. 179) Maddox Fisher is the only proved child of Thomas Fisher. From the 1709 administration and use of the term "children," we know there was at least one more. Tabitha, wife of John Johnson, may have been a daughter. Thomas' wife, Patience, left a will as Patience Marshall in 1765, in which she named grandson (great grandson) Esme Bayly, grandson Hezekiah Tilney, two daughters, Patience and Margaret, and sons Esme and Thomas John Marshall; Thomas Fisher Sr. (her grandson) was an executor along with her sons Esme & Thomas John Marshall. Patience had many grandchildren at the time of her death, but did not name them in her will.
She married Francis Wainhouse in Northampton Co., VA, before April 28, 1709. Francis was the son of Francis Wainhouse. Francis died 1717 in Northampton Co., VA. She married Thomas Marshall (Mjr.) in Northampton Co., VA, about 1718. Thomas was born in Northampton Co., VA 1692. Thomas was the son of John Marshall and Sarah (N) (wife of John Marshall). Thomas died before January 19, 1760 in Northampton Co., VA. A Thomas Marshall was testator to the will of Alexander Maddux on April 10, 1717, Somerset County, MD. This was probably Thomas d. 1760 of Northampton, as the Thomas d. 1786 of Somerset was a small boy in 1717. From the other witnesses to Maddux' will, although it was recorded in Somerset County, it may have been witnessed in Northampton County. It does not appear that Thomas Marshall was in Somerset in 1717 or a relationship, if any, to Alexander Maddux is not known other than being a near neighbor to Maddux' Northampton property.
Thomas Marshall was a member of the House of Burgesses from the Eastern Shore, Northampton County, 1723-1734. (research of C. Hayward Marshall Sr. and W. Marshall Scott)
1752, Thomas Marshall of Northampton Co. VA, appointed administrator of estate of Elisabeth Dashiell, widow of Col. George Dashiell, of Somerset Co. MD. (research of Vernon L. Skinner) Elizabeth Dashiell is mother of George Dashiell, Jr., who married Thomas' step-great granddaughter, Rose Fisher. She was the widow of James Fairfax d.c. 1739. Thomas Marshall had been a witness to the will of James Fairfax. Rose Fisher (who would marry George Dashiell, Jr.) was only 7 years old, so the relationship of Thomas Marshall to Elizabeth Fairfax Dashiell existed prior to the marriage of Rose and George Dashiell, Jr. Rose Fisher & George Dashiell, Jr. name a son, James Fairfax Dashiell. George Dashiell was named next of kin in prerogative court for the estate of Thomas Marshall in 1761. Circumstantially, it appears Elizabeth Fairfax Dashiell is Thomas' sister.
Thomas' will was filed both in Northampton County, VA and Somerset Co., MD. William Allen (his son-in-law) was a creditor and was probably in Somerset at the time and this may be at least one reason by his will was filed in Maryland. That Thomas owned any land in Somerset has not been identified. Thomas' son, Esme, was in Worcester County in 1760 and his son, Thomas John, was in Dorcester.
Thomas' will was dated January 19, 1760, Northampton County, VA, and proved March 10, 1761. It appeared in both Northampton Co., VA and in Somerset Co. MD. (EB4, p. 75, Clerk's Office, Princess Ann, MD, copied by William Marshall Scott; James H. Marshall, Wills & Administrations of Northampton Co., p. 388)
Thomas Marshall, Gentleman, Somerset Co. MD, 263 pounds, 3 shillings, 10 pence, February 25, 1761 August 17, 1762, William Allyn Creditor, next of kin George Dashiell, executors Thomas Marshall & Esme Marshall. (Prerogative Court Abstracts 1760-1763)
Patience was a defendant in a court case in Northampton Co., VA, 1710. According to Purse & Person and Whitelaw, Patience married 1st Thomas Fisher (See the Fisher Family Journal) and 2nd Francis Wainhouse. With the following information, compelling evidence is given that Patience married 3rd Thomas Marshall. In her will, probated November 8, 1765, Patience Marshall named her daughter Margaret (Wainhouse) Haggoman, a child of Francis Wainhouse named in his 1717 will. Margaret married first Joachim Michael and William Haggoman second.
September 28, 1710, Court, Northampton Co., VA: this day the action of the case between Alexander Bagwell and Francis Wainehouse as marrying Patience Fisher executors of Thomas Fisher deceased defendant being called in July Court last and by consent of both plantiff and defendant...judgement is granted by the plantiff against the defendant for the sum of 400 pounds of tobacco to be paid out of the estate of Thomas Fisher deceased with cost of suit. (Frank V. Walczyk, Northampton Co. VA Orders & Wills 1698-1710, Vol. II, 1704-1710, Peter's Row, Coram, NY, 2001, p. 174)
Thomas Marshall was named guardian to Francis and Margaret Wainhouse, for whom he filed an accounting in 1724. Accomack court records state that Thomas was made guardian for these orphans of Dorothy Wainhouse on her marriage. Dorothy was Francis Wainhouse, Sr.'s sister. She was probably the first guardian after his death and she married about 1715. The Accomack records do not say 'why' Thomas Marshall was named, but it appears he married Patience about 1718-19.
Patience also named her grandson, Esme Baily, son of Edmund and Rose Bayly, in her will (although Isma Bayly was her great grandson by her granddaughter, Rose Fisher) and Thomas Marshall was Isma Bayly's guardian at the death of his father, Edmund Bayly in 1751. The administration of Thomas Fisher's estate was granted to Patience on behalf of herself and her children in 1709. Records show that Maddox Fisher was the son of Thomas Fisher; however, the names of any siblings are not provided. The use of the word "children" in the administration indicates more than one. A Tabitha Johnson, wife of John d. 1754, named her son Ismy; neither Tabitha Johnson nor Ismy Johnson were named by Patience (John predeceased and Tabitha's date of death is unknown) but there were many relations between the Marshalls and Johnsons. In addition, Patience's son, Francis Wainhouse married a Bridget Johnson.
Patience named her children by Thomas Marshall in her will, including Esme Marshall, their eldest son. Based on approximate dates of birth for Maddox Fisher, Sr., the probate for Thomas Fisher's estate and marriage to Francis Wainhouse, Sr., Patience was probably ten or so years senior to Thomas Marshall. She would have married at about age 15 had children in her late 30's and lived into her 80's.
Patience's maiden name is not known. She signed her mark "V."
Patience "V" (Fisher, Wainhouse, Marshall) and Thomas Marshall (Mjr.) had the following children:
2 i. Patience2 Marshall. Patience died after 1776. She married William Allen. William was born about 1725. William was the son of Francis Allen and Mary(wife of Francis Allen). William died 1790 in Worcester Co., MD. William took the Oath of Allegiance in Worcester Co. in 1778 before the Hon. Nehemiah Holland. He rendered patriotic service by supplying corn for the use of the military on February 20, 1780 and July 10, 1780, and by supplying beef on October 10, 1781. He served as Sheriff of Somerset Co. 1755-1758, Justice of Worcester Co. 1764-1775, and was recorded as being delinquent when required for militia service in 1782. (Henry C. Peden, Jr., Revolutionary Patriots of Worcester & Somerset Cos. MD, Willow Bend, Westminster, MD, 1999, p. 5)
His father left him law books, large Bible and Common Prayer Book. The property, land and tenements at Nassawattix Neck, Worcester County and personal estate were to be divided by the children of Mary Allen after her death. William also received lands called Africa of America, Greens Chance, Cork and Kingsale.
+ 3 ii. Esme Marshall was born about 1720.
+ 4 iii. Sarah Marshall was born about 1724.
+ 5 iv. Thomas John Marshall (Mjr.) was born about 1725.
Patience "V" (Fisher, Wainhouse, Marshall) and Thomas Fisher had the following children:
+ 6 v. Maddox Fisher was born about 1697.
+ 7 vi. ?Tabitha Fisher was born before 1709.
Patience "V" (Fisher, Wainhouse, Marshall) and Francis Wainhouse had the following children:
+ 8 vii. Francis Wainhouse was born about 1710.
+ 9 viii. Margaret Wainhouse was born about 1710.
3. Esme2 Marshall (Patience1 "V") was born in Northampton Co., VA about 1720. Esme died 1784 in Worcester Co., MD.
He married twice. He married Mary Nairn about 1745. Mary was born in Somerset Co., MD before September 22, 1732. Mary was the daughter of Robert Nairn(II) and Jannet Watts. Mary died before April 18, 1767 in Worcester Co., MD. Mary was named in the will of her grandfather in 1732 and by her cousin, Francis Drummond, in 1741. Her father only named two of her children in his 1761 will (Robert Henry Marshall and Elizabeth Marshall). Mary was not named in the Tri-Partie deed by her mother in 1767. In his 1771 will, John Nairn named the children of his sister Mary, but did not name her specifically. A deed for "Hog Quarter" abstracted by Ruth Dryden shows Esme Marshall and his wife Mary and that Mary was under age. It appears Mary Nairn died before September 1, 1764, the date of the deed for "Hog Quarter."
He married Mary Brittingham in Worcester Co., MD, about 1764. Mary was the daughter of Elijah Brittingham and Sarah Newbold. She was called Mary Brittingham in her father's will. Esme Marshall and his under age wife, Mary, sold "Hog Quarter" for 5 shillings to George Layfield and John Nairn. Layfield and Nairn would have been relations to Esme's wife, Mary Nairn. Esme's first wife, Mary Nairn, would not have been under age in 1764. Mary Brittingham may have been Esme's second wife.
Esme's three children not named by his first wife's brother may have been by his second wife, Mary (Brittingham): George, Priscilla and Isme.
Esme was the eldest son of Thomas Marshall and shown as Ishmael on some documents. (Northampton Orders 1732-1742, pp. 405, 443; Accomack District Court Orders 1789-1797, p. 300, copied by James Marshall) He was in Worcester Co., MD by 1760. On 1 Sept 1764, Esme and Mary** sold 250A of 'Hog Quarter' to George Layfield and John Nairn for 5 shillings, Mary was under age. In 1767, he sold 269A in Northampton and purchased 'Rudder' at Pitts Creek Hundred. Esme's son, Thomas, bought 'Rudder' from Esme in 1772. 'Rudder,' 'Brittingham's Chance,' and 'Brittingham's Addition,' were all acquired by Esme from the widow of descendants of Elijah Brittingham. (Ruth T. Dryden, Land Records of Worcester Co. MD, pp. 75, 134, 394, 533)
**The land abstract for 'Hog Quarter' shows Esme and wife Mary sold...she was under age. Mary Nairn was named by her grandfather in 1732, so she could not have been under age in 1764. It is suspicious that Mary Nairn died by 1764 and Esme married a second time to a Mary, possibly Mary Brittingham, daughter of Elijah.
Mary Nairn is not named in the tri-partie agreement before the marriage of her mother, Janet Nairn, to Jabez Pitts, nor is she named in the 1771 will of her brother, John.
The 1771 will of John Nairn, Mary's brother, provided the names of Mary and Esme's children, as Esme died without a will. Bonds were posted 5 Oct 1784 for the administration of Esme's estate in Worchester Co, MD by George Marshall, Thomas Marshall and John Marshall rejected the administration. Thomas and John Marshall provided inventory and the next of kin were listed as Levin and Theophilus Marshall.(Ruth Dryden, Worcester Admin. Bonds & Inventories, p. 15)
John Nairn named the children of his sister, Mary: Thomas, John, Robert and William.
NOTE: The George Marshall who administered the estate is probably the same George Marshall for whom Thomas, son of Esme, holds a mortgage in Worcester County. He is not named in the will of John Nairn as a child of Mary Nairn, nor is he named in the will of William Allen. Patience Marshall who married William Waller is not named by John Nairn or William Allen. George and Patience might have been children from Esme's second marriage; George may have been a child of the second marriage and Patience deceased by 1771. That they were children of Esme is not proved and based in large part on the names of their children--George Esme Marshall and Esme Marshall Waller.
The 1810 census of Worcester County shows what looks like Isme or Ismel Marshall as 45+ with one female 10-16 and one female 26-45. If this is Isme, he is too old to be Esme's grandson. Again, neither John Nairn nor William Allen named an Isme/Esme in their wills.
Esme Marshall and Mary Nairn had the following children:
+ 10 i. John Drummond3 Marshall.
+ 11 ii. Patience Marshall.
+ 12 iii. George Marshall.
+ 13 iv. Thomas Marshall was born September 9, 1746.
+ 14 v. Robert Henry Marshall was born about 1750.
+ 15 vi. Elizabeth Marshall was born about 1753.
+ 16 vii. William Allen Marshall was born March 28, 1759.
Esme Marshall and Mary Brittingham had the following child:
17 viii. ?Isme Marshall was born about 1764. What appears to read Isme or Ismel Marshall is found in the 1810 census of Worcester Co. MD. It is not known if this is, indeed, the given name or if he is a son of Esme.
4. Sarah2 Marshall (Patience1 "V") was born about 1724. Sarah died before 1760.
She married twice. She married Jonathan Tilney in Northampton Co., VA, June 22, 1742. Jonathan was the son of John Tilney(III). Jonathan died about 1742 in Northampton Co., VA. Court record of May 12, 1742, Northampton Co., VA: "Account of sale of the estates of Anne & Hezekiel Tilney Orphans was returned sworn to by Thomas Marshall, Gent., their guardian and orders to be recorded. Children of Jonathan and Sarah Marshall Tilney." (Gustave Anjou, The Tilney Family 1658-1902, p. 55)
She married Robert James in Northampton Co., VA, June 5, 1751. Robert was the son of Thomas James. Robert died 1759 in Northampton Co., VA. Robert James married 2nd Elizabeth Christian.
Sarah Marshall and Robert James had the following children:
+ 18 i. Thomas3 James.
+ 19 ii. Robert James was born before 1753.
Sarah Marshall and Jonathan Tilney had the following children:
20 iii. Ann Tilney. Ann died before 1760.
21 iv. Hezekiah Tilney was born in Northampton Co., VA about 1742. Hezekiah died 1776 in Worcester Co., MD. He married Elizabeth Atkinson. Elizabeth was the daughter of Angelo Atkinson and Rachel Laws.
5. Thomas John2 Marshall (Mjr.) (Patience1 "V") was born in Northampton Co., VA about 1725. Thomas died 1773 in Dorchester Co., MD.
He married Sarah Darby in Northampton Co., VA, about 1750. His father's 1761 will left him and his brother, Esme, land in Nasswadox Neck between Ouchanock and Nasswadow Creeks, beginning at the south branch of Marshall's creek at a marked tree in field which Thomas John was then planting, not molesting the 100A which was given each son by deed of gift, but including that in the whole land and 500A bought of Abner Brickhouse on sea-side known by name of Brickhouse's Marsh; neither to sell to an outside person but must sell to the other brother.
Thomas John was Sheriff and Justice of the Peace for Northampton Co VA. He purchased 500A 'Carthagena' on a branch of Secretary Creek near New Market. (James H. Marshall's research from Dorchester Deeds HD 30, p. 113, Minutes, p. 108, 1783 tax list, Great Choptank Parish Records, Deeds HD4, p. 592; Robert K. Headley, Jr., 18th Century VA Newspapers, p. 38)
His purchase of "Carthagena" on June 25, 1768 is the earliest record of his being in Dorchester County. (Notes of James H. Marshall from Deeds Old 22, p. 386) It is presumed most his children were born in Northampton County, VA.
Thomas John married Sarah Darby, bond dated 12 February 175_, secured by Thomas Barlow. (Stratton Nottingham, Marriage License Bonds of Northampton Co. VA 1706-1854)
His will is dated March 13, 1773 and proved May 6, 1773, Dorchester Co., MD. He named wife, Sarah, and son, John, as executors. He left the north side of easternmost branch to John and south side of branch to Theophilus. If John dies without issue or before he sold, then to Levin. If Theophilus died without issue or before he sold, then to Henry. If John and Levin died without issue or before either sold, then to James. If Theophilus and Henry die without issue or before they sold, then to James. After wife's death, his moveable estate was to be equally divided among his eight children: John, Theophilus, Patience, Sarah, Leavin, Mary, Henry and James; John and Theophilus not to have any part of the Negroes. Wit: John Anderton, Thos. Muir, Bartholomew Adams. Estate presented July 27, 1773, settled November 29, 1773: appraisers were John Dickenson and John Anderton; creditors were Henry Hooper 2nd and Henry Steele; next of kin was John Darby; executor John Marshall; L739.19.2 (DO 115.222)
Dorchester Land Records Vol 3HD 299 1791 shows Thomas John Marshall, deceased, and his son Theophilus Marshall. (Dorcester County Maryland Genealogical Magazine, Vol. II, No. 4, Nov, 1981, p.8)
Thomas John Marshall (Mjr.) and Sarah Darby had the following children:
22 i. James3 Marshall. 1783 tax list of Dorchester Co. MD p. 10 shows Theophilus Marshall, agent for James on land in Middle Distrist. James is shown on p. 9 taxed in Middle District.
Inventory in 1783 for a James Marshall, Caroline Co. (Vern Skinner)
A James Marshall m. 1799 Nancy Jones. A James Marshall m. 1817 Nancy Davis.
1800 census of Dorchester shows a James, p. 9, b. 1774-1784. If the age is correct, this James is too young to be son of Thomas John.
23 ii. Patience Marshall. Patience died after 1773.
24 iii. Sarah "Sally" Marshall. She married Thomas Brereton February 26, 1781. Notes of James H. Marshall: the marriage record describes her as the daughter of Mjr. Thomas Marshall of Northampton Co. (18th Century Virginia Newspapers by Robert K. Headley, Jr., 1987, p. 38). This marriage record sounds similar to one in the Dielman File at the Maryland Historical Society, and this latter record suggests Thomas John as Sarah or Sally's father. Thomas John did name a daughter, Sarah. The Breretons were justices of the peace in Somerset County, MD.
25 iv. Mary Marshall. Mary died after 1783. Mary may have married John Oram in Dorchester Co., MD.
In 1783, she is cited in the household of her brother, John.
+ 26 v. John Marshall was born about 1752.
+ 27 vi. Theophilus Marshall was born 1755.
+ 28 vii. Levin Marshall was born about 1756.
+ 29 viii. Henry Marshall was born about 1761.
6. Maddox2 Fisher (Patience1 "V") was born in Northampton Co., VA about 1697. Maddox died after 1737 in Northampton Co., VA.
He married Sarah (wife of Maddox Fisher). Sarah died after 1749. In 1737, Maddox sold his undivided third interest in 400A at the mouth of Muddy Creek, inherited from his father, Thomas Fisher, to Thomas Marshall (will dtd 1760). This was land Philip Fisher had bequeathed in 1702 to his sons, John, Thomas and Philip. That same land was sold in 1769 by Thomas Marshall's sons, Esme and Thomas John. (Ralph T. Whitelaw, Virginia's Eastern Shore)
Maddox Fisher and Sarah(wife of Maddox Fisher) had the following children:
+ 30 i. Maddox3 Fisher was born about 1710.
+ 31 ii. Rose Fisher was born about 1715.
7. ?Tabitha2 Fisher (Patience1 "V") was born before 1709. ?Tabitha died after 1754 in Northampton Co., VA.
She married John Johnson. John was the son of Obedience Johnson (Jr.) and Dorothy Washburne. John died before April 9, 1754 in Northampton Co., VA. It is NOT proved that Tabitha was a daughter of Thomas & Patience Fisher. It is based solely on Patience having "children" and that Tabitha named her son Esme.
?Tabitha Fisher and John Johnson had the following children:
33 ii. Rose "Rosey" Johnson. Rose died after 1785. She married William Elliott July 16, 1774.
34 iii. Lucretia Johnson. Lucretia died before September 9, 1777 in Northampton Co., VA.
35 iv. John Johnson (Jr.). John died 1775 in Northampton Co., VA. He married Margaret "Peggy" Turner 1774. Margaret was the daughter of George Turner and Sarah Smith. Margaret died after 1775. (Ralph T. Whitelaw, Virginia's Eastern Shore, p. 518) John did not name his wife in his will. (James Marshall, Wills & Administrations of Northampton Co., VA, p. 440)
+ 36 v. Obedience Johnson.
39 viii. Ismay or Esme Johnson was born before 1738.
8. Francis2 Wainhouse (Patience1 "V") was born in Northampton Co., VA about 1710. Francis died 1760 in Accomack Co., VA.
He married Bridget Johnson. Bridget was the daughter of Obedience Johnson (Jr.) and Dorothy Washburne. Bridget died 1761.
He made a will in Accomack Co., VA, January 28, 1760. Francis's will was probated in Accomack Co., VA, February 26, 1760. Francis was named in his father's will and was under age 18. Thomas Marshall was shown as guardian to Francis and presented inventory and appraisal on 3 February 1724, Accomack Court. The court record for 10 July 1724 shows Thomas Marshall guardian to Francis, orphan of Dorothy Wainhouse, now the wife of Capt. Scarburgh. (research of court records by James H. Marshall) However, Francis was the son of Francis, brother of Dorothy. Dorothy may have been his first guardian. Francis named his wife and children in his will.
Francis Wainhouse and Bridget Johnson had the following children:
+ 40 i. Francis3 Wainhouse (III).
44 v. Patience Wainhouse. In 1765, a Patience Maxwell, wife of Daniel, of North Carolina, sold Lot 11 in Onancock Town, to Anne Wainhouse, widow of Francis. (Whitelaw p. 913)
9. Margaret2 Wainhouse (Patience1 "V") was born about 1710. Margaret died 1768 in Northampton Co., VA.
She married twice. She married Joachim Michael about 1724. Joachim was born in Northampton Co., VA about 1703. Joachim was the son of John Michael(II) and Sarah Fisher. Joachim died May 7, 1752 in Northampton Co., VA. Will dated April 30, 1752, probated June 9, 1752, Northampton Co., VA. (James H. Marshall, Wills & Admin. NH Co., VA)
She married William Haggoman after 1752. William was the son of John Haggoman (Sr.) and Sarah Powell. William died before April 10, 1764 in Northampton Co., VA.
She made a will in Northampton Co., VA, April 11, 1768. Margaret's will was probated in Northampton Co., VA, September 13, 1768. Thomas Marshall was named guardian to Margaret and presented inventory and appraisal 3 February 1724, Accomack Court. Court record 10 July 1724 shows Thomas Marshall guardian to Margaret Wainhouse, orphan of Dorothy Wainhouse, now the wife of Capt. Scarburgh. (Research of Court records by James H. Marshall) However, Margaret was the daughter of Francis Wainhouse, Dorothy's brother. Her aunt, Dorothy, appears to have been her first guardian and Thomas Marshall on his marriage to Patience became her next guardian.
Margaret Haggoman was named daughter by Patience Marshall in her will of 1765.
Margaret Wainhouse and Joachim Michael had the following children:
+ 46 i. Patience3 Michael.
48 iii. Joachim Michael. Joachim died 1773. He married Mary Blaikley Stith in Northampton Co., VA, 1770. Mary was the daughter of Griffin Stith and Mary Blaikley. Mary died November 14, 1822. (ref: Will Wilkins - Ghote)
49 iv. William Wainhouse Michael. William died 1772. He married Margaret Downing. Margaret was the daughter of Zorabable Downing.
50 v. Thomas Michael. Thomas died before June 12, 1759 in Northampton Co., VA. He married twice. He married Ann(wife of Thomas Michael). He married Comfort Waterson in Northampton Co., VA, December 30, 1747. Comfort was the daughter of John Waterson and Elizabeth(wife of John Waterson). Comfort died before 1758.
51 vi. Rose Michael. Rose died 1760 in Northampton Co., VA.
+ 52 vii. John Michael was born February 3, 1746.
Margaret Wainhouse and William Haggoman had the following child:
53 viii. William Haggoman (Jr.). William died 1827.
30. Maddox3 Fisher (Maddox2, Patience1 "V") was born about 1710. Maddox died 1749 in Northampton Co., VA.
He married Sussanna Dolby-Dalby about 1736. Sussanna was the daughter of John Dolby(Jr.). Sussanna died after 1751.
He made a will in Northampton Co., VA, January 8, 1749. Maddox's will was probated in Northampton Co., VA, March 13, 1749.

By his father's will, Edmund was to be under the guide & direction of an uncle, Morris Shepherd. Hannah Scarburgh's sister, Edmond Memoria Scarburgh, married Morris Shepherd, making him uncle to Hannah's children. Edmund received all his father's land on the seaside, containing 800 acres. (Stratton Nottingham, Wills & Admin. Acc. Co., p. 57-58) Edmund named his children, friend Joachim Michael and son John were executors. Thomas Crippen was a witness to the will; Thomas was his brother-in-law. Probate shows Littleton Scarburgh Major appointed guardian to Edmund, heir at law to the testator. (Stratton Nottingham, Wills & Admin. Acc. Co., p. 160-161) The tombstone of Thomas Bayly says he was the son of Edmund Bayly and Rose Fisher, daughter of Maddox Fisher, grandson of Edmund Bayly, and great grandson of Richard Bayly of Craddock. (Ralph Whitelaw, VA Eastern Shore, p. 980) Mjr. Esme Bayly of Somerset was "uncle" of Col. Thomas Bayly of Accomack. (Isaac W.K. His wife, Anne, married Abel Joynes, d. 1781 Accomack Co. VA (Nottingham 334, Whitelaw 913, 560) Anne Joynes, Elizabeth Downing and Sarah Powell united in a deed for Lot 11, Onancock Towne, for two houses and three lots, to Noah Belote in 1780 (Whitelaw 913).

Chapman, Wills & Administrations of Isle of Wight County, Smithfield, VA 1975)
John Michael and Margaret Christian had the following children:
81 iv. William Christian Michael. Note: the will abstract called William "brother;" however, John's brother was William Wainhouse Michael. John's wife was Margaret Christian, and this is probably the son, not brother, of John Michael. Further search is needed.
10. John Drummond3 Marshall (Esme2, Patience1 "V") birth date unknown. John died before April 22, 1800 in Worcester Co., MD.
He married twice. He married Ann "Nancy" Wailes May 2, 1776. Ann was the daughter of John Wailes. Ann died October 18, 1789 in Worcester Co., MD. He married Delilah Brittingham in Worcester Co., MD, May 9, 1793. Delilah was the daughter of Solomon Brittingham and Mary(wife of Solomon Brittingham). Mary Brittingham's will was probated in 1784; she named her daughter Deliliah Purnell and three grandchildren: Mary, Milby and Sarah. (Vernon L. Skinner, Worcester Co., MD Wills JW13, p.3) John Drummond is shown as the second son of Esme and Mary Marshall. He was under age in 1764. The "Maryland Herald & Eastern Shore Intelligencer" of April 22, 1800 shows Elizabeth Marshall and Benjamin Wailes as administrators of John D. Marshall late of Worcester County, Pitts Creek Hundred. (F. Edward Wright, Maryland Eastern Shore Newspaper Abstracts; Worcester Deeds Liber F, p. 217, researched by James Marshall)
On May 8, 1800, Benjamin Wailes & Elizabeth Marshall, administrators for the estate showed the following property: Negroes Levin, Ned, Leah, Attalanta, Henry. (David V. Heise, Worcester Co. MD Orphans Court Proceedings, Vol. 1, 1777-1800, p. 303)
A John Marshall served as a Sergeant in the Somerset Militia, Princess Anne Battalion under Capt. George Waters' Pocomoke Company, 1780. Because he took the Oath of Allegiance in Worcester in 1778 before the Hon. James Selby, (Henry C. Peden, Jr., Revolutionary Patriots of Worcester & Somerset Cos. MD, Willow Bend Books, Westminster, MD, 1999, p. 188) this John may be the brother of Robert, William, Thomas and George, all of whom took the Oath in 1778 before James Selby. William, Thomas and George all served in Worcester Militia. A Robert Marshall also served in the Princess Anne Battalion.
John Drummond Marshall and Ann "Nancy" Wailes had the following children:
82 i. Esme4 Marshall was born in MD March 3, 1779. His date of birth was recorded in back of John Marshall's prayer book. (copy at Maryland Historical Society)
Marriage records of Daviess Co IN show an Esme P. Marshall married Sarah Sinks, bond dated February 27, 1825.
Esme of John D. Marshall would have been about 46 years old in 1825. It would appear that this Esme is the Esme P. Marshall of the 1830, 1840 and 1850 census of Daviess County, b. 1799 KY. A search of Marshalls in KY in 1820 shows no Esme, E.P., or Erma (the names as indexed in later census). Because the name is so rare, Esme P. Marshall of Daviess County could be the son of Esme of John D., who would have been age 20 when Esme P. was born.
1830 census, Daviess Co., IN: Esme Marshall (p. 375) 2M-5, 1M15-20, 1F20-30, 1F-5, 1F10-15, 1F15-20, 1F20-30
1840 census, Daviess Co., IN: E.P. Marshall (p.26) 1M-5, 2M10-15, 1M40-50, 2F5-10, 1F10-15, 1F30-40
1850 census, Veal Township, Daviess Co., IN: Esma P. Marshall, age 51 (b. 1799), Potter, born in Kentucky; wife Jane 42; William 22; Hannah 7; Charles H. 5; Esma P. 2; Caroline (N) age 19 in household.
83 ii. Elizabeth Marshall was born in Coventry Parish, Somerset Co., MD July 2, 1780.
+ 84 iii. Mary Marshall was born March 19, 1782.
85 iv. Sarah Marshall was born in Coventry Parish, Somerset Co., MD February 22, 1786. Sarah died after 1809. October 11, 1798, Administrator for estate of John D. Marshall was to pay William A. Marshall 1/3 of estate as guardian to Sarah. (David V. Heise, Worcester Co. MD Orphans Court Proceedings Vol. I, 1777-1800, p. 299) On April 8, 1800, orphan Sally Marshall is shown with her guardian, William Allen Marshall. Sureties: Frederick Coner and Milby Purnell. (David V. Heise, Worcester Co. MD Orphans Court Proceedings Vol. I, 1777-1800, p. 295) Sarah, with her sister, Mary Smith, sold in 1809 "Marshalls Conclusion" which they inherited from their father, to William Purnell.
11. Patience3 Marshall (Esme2, Patience1 "V") birth date unknown. Patience died before 1784.
She married William Cottman Waller about 1764. William was born in Somerset Co., MD October 14, 1743. William was the son of Richard Waller and Ann Cottman. William died 1774. There is no definitive proof that William Cottman Waller's wife was the daughter of Esme Marshall. Esme Marshall died intestate and his children thus far identified have been through wills or documents of other family members, such as Mary Nairn's brother, John. John Nairn died in 1771 and named his sister's children. He did not, however, name Patience. After basing a relationship from Esme Marshall to Esme Marshall Waller purely on the given names and dates and assuming Esme Waller's mother was a daughter of Esme Marshall, Vern Skinner found a notation in Charles S. Waller's "The Chesapeakers" that William Cottman Waller married a Patience Marshall. The theory still holds and is now even more enhanced that this daughter was named after Esme Marshall's mother.
Patience Marshall and William Cottman Waller had the following child:
+ 86 i. Esme Marshall4 Waller (Col.) was born about 1765.
12. George3 Marshall (Esme2, Patience1 "V") birth date unknown. George died after 1788.
George Marshall was administrator of Esme Marshall's estate. No other information has been found to confirm he was Esme's son. No other George's in this family can be identified as old enough or in Worchester County to have served in this capacity. It is believed that this George is the father of George Esme Marshall. No further information on George or George Esme Marshall has been found. William Allen and John Nairn, when naming children of Esme or Mary Nairn Marshall do not name a George. He may have been the son of Mary Brittingham.
Thomas Marshall was surety for George Marshall at Pitts Creek, Worcester County on the 1783 Tax List. (Maryland State Archives 1783 Tax List) A notation is shown on the 1783 tax list compiled by Ruth Dryden saying "young man Thomas Marshall Sec."
George Marshall submitted the final accounting of Esme's estate in 1788, Somerset Co., MD. (notes of Vernon L. Skinner)
A George Marshall served as Sergeant, Worcester Militia, Wicomico Battalion, under Capt. Isaac Layfield's Company, July 15, 1780. He took the Oath of Allegiance in Worcester County in 1778 before the Hon. James Selby. (Henry C. Peden, Jr., Revolutionary Patriots of Worcester & Somerset Counties, MD, Willow Bend, Westminster MD, 1999, p. 188)
George Marshall had the following child:
87 i. George Esme4 Marshall. He married Elizabeth Hayes in Worcester Co., MD, April 9, 1827. The marriage record for George Esme and Elizabeth is in Worcester County. No other information has been located to prove him as the son of George Marshall or identify his descent from Esme Marshall except his middle name.
13. Thomas3 Marshall (Esme2, Patience1 "V") was born in Northampton Co., VA September 9, 1746. Thomas died 1791.
He married Esther Marshall** in Conventry Parish, Somerset Co., MD, March 25, 1766. Esther was born in Conventry Parish, Somerset Co., MD January 6, 1748. Esther was the daughter of Thomas Marshall** and Jane Bosman(widow of Abraham Heath). Esther died after December 26, 1786. NOTE: Surname Marshall identified with ** indicates the Bayside Marshall family. Esther's ancestors and siblings can be found at the ghote, Miles Files by M.K. & Barry Miles. Information about Thomas and his wife, Esther, is recorded in the back of a prayer book belonging to his brother, John D. Marshall. The prayer book was given to the Maryland Historical Society by Mrs. Bell Johnston Bushnell in 1943. Notes in the file state that Mrs. Bushnell was a great great granddaughter of Thomas Marshall 1746-1791. (John D. Marshall prayer book, Maryland Historical Society, Baltimore, MD; transcript of prayer book File Case A #117 MHS)

A Thomas Marshall served as Captain of the Worcester Militia, Snow Hill Battalion, August 30, 1777, taking the Oath of Allegiance in Worcester County in 1778 before the Hon. James Selby. Another Thomas Marshall served as a 1st Lt. of the Worcester Militia. (Henry C. Peden, Jr., Revolutionary Patriots of Worcester & Somerset Counties, Willow Bend Books, Westminster, MD, 1999, p. 188) Because of his age, it is thought Thomas of Esme was Captain, and his cousin, Thomas of John, was the 1st Lieutenant.

WHO WAS THOMAS MARSHALL AND HIS WIFE ESTHER MARSHALL? With the information found in the prayer book of John Drummond Marshall, Thomas Marshall and his wife, Esther Marshall, are identified. Thomas is a descendant of the Northampton family and Esther is a descendant of the Bayside, or Someret, family.
Thomas Marshall was born September 9, 1746, Northampton Co. VA, and died after December 26, 1786. He was the son of Esme Marshall and Mary Nairn. Thomas married Esther Marshall on March 25, 1766 in Somerset Co., MD. Esther Marshall was born January 6, 1748-9 Somerset Co., MD, the daughter of Thomas Marshall and Jane. Thomas and Esther Marshall had at least three children whose births were recorded in Coventry Parish records, Somerset Co., MD. Thomas was named father of Mary Marshall in the will of Mary's grandfather, Thomas Marshall, dated April 24, 1786 Somerset Co. MD. Thomas bought land in Worcester Co. MD in 1768 and either bought or was given other parcels in that county in 1771, 1772, 1773 and 1786. The 1783 Tax List shows Thomas with 244 acres at Pitts Creek, Worcester County: "Conveniency" and "Rudder." There are 4 males of age and 2 females. Thomas and his wife, Esther, sold several parcels in August and December, 1786.

The John Drummond Marshall prayer book: Records recorded by John Drummond Marshall in his prayer book were transcribed and filed at the Maryland Historical Society, Baltimore, MD, and later the prayer book itself was given to the Society. John Drummond Marshall recorded his first marriage, births of his children, brother-in-law and 1st wife's deaths in the prayer book. He (or the next owner of the prayer book) then devoted all other records in the prayer book to the lineage and descendants of Mary Marshall, his niece, daughter of his brother Thomas. Entries were made to the prayer book after John Drummond Marshall's death in 1800 regarding the marriage of Mary Purnell to Levin Stewart and the births of their children, indicating the prayer book's possession may have passed to Mary Marshall Purnell and/or her daughter, Mary Purnell Stewart.
Thomas Marshall and Esther Marshall** had the following children:
+ 88 i. Mary4 Marshall was born March 10, 1768.
89 ii. Stephen Marshall was born in Conventry Parish, Somerset Co., MD April 22, 1770. Stephen died before 1786.

Marshall, Sr. & William Marshall Scott; Records of William Whittington transcribed by Mrs. M. C. Darnell, The Register of the Kentucky Historical Society, Vol. 47, No. 161, October, 1949) See Whittington Family Journal.
He married Esther Fountain Hall in Somerset Co., MD, July 11, 1803. Esther died 1815 in Somerset Co., MD. The marriage record shows Esther with surname Hall. Robert calls her Esther Fountain in his will. No marriage record has been found of an Esther Fountain to a Hall; however, it is suspect that she was the widow of a Hall related to Robert's daughter-in-law, Elizabeth Hall, or the widow of one of the sons of William Hall (Isaac, Levi Wood or John) who lived next to the Marshalls at "Pimore."
He made a will in Somerset Co., MD, May 26, 1814. Robert and his family lived at "Tarso", inherited from his uncle, John Nairn in 1771. "Tarso" was located west of the Pocomoke River (a little over a mile) and about two miles south of the Rehobeth Plantation. It adjoined "Pimore" and "Nairn's Addition" and bordered "Late Discovery" on the southern line. (about half-way between the towns of Rehobeth and Shelltown and Rehobeth Road probably runs through the old property) Robert is shown paying the 1783 taxes. Members of the family continued at "Tarso" until Robert's grandson sold it to Isaac T. Marshall. (notes of William Marshall Scott & C. Hayward Marshall, Sr.)
1810 census shows him at Pocomoke Hundred, Somerset as 45+, with 1F10-16, 1F16-26, and 1F45+. Ennumerated on either side are Isaac Riggin and Noah Riggin, Martha Hall, Sarah Riggin and then the household of his son, Robert N. Marshall.
A Robert Marshall was a Private, Somerset Militia, Princess Anne Battalion, St. Asaph's Co., 1780. He took the Oath of Allegiance in Worchester Co. in 1778 before the Hon. James Selby. (Henry C. Peden, Jr., Revolutionary Patriots of Worcester & Somerset Cos. MD, Willow Bend, Westminster, MD, 1999, p. 188)
Robert Henry Marshall and Mary "Polly" Whittington had the following children:
+ 91 i. Robert Nairn4 Marshall was born May 4, 1780.
92 ii. Elizabeth "Betty" Marshall was born in Somerset Co., MD about 1783. Elizabeth died before May 26, 1814. Betty's name (or any descendants) is not found in her father's will of 1814. She is shown as a daughter of Robert and Mary who died between 1806 and 1814 in "The Littleton Heritage" by Matthew Wise and is recorded as daughter of Robert & Mary Marshall in Records of William Whittington transcribed by Mrs. M. C. Darnell, The Register of the Kentucky Historical Society, Vol. 47, No. 161, October, 1949.
+ 93 iii. Esther Marshall was born about 1787.
+ 94 iv. Mary Jackson Marshall was born 1795.
15. Elizabeth3 Marshall (Esme2, Patience1 "V") was born about 1753.
She married Benjamin Purnell in Worcester Co., MD, about 1766. Benjamin was born in Worcester Co., MD 1740. Benjamin was the son of Matthew Purnell and Martha McClemmy. Benjamin died 1796 in Worcester Co., MD. He made a will in Worcester Co., MD, December 10, 1795. Benjamin's will was probated in Worcester Co., MD, January 19, 1796. His father left him land at "Purnell's Security." (Ruth T. Dryden, Worcester Co. MD Land Records)
Benjamin was an Esign, Worcester Militia, Sinepuxent Bn., Capt. John Purnell's Co., August 30, 1777, and 2nd Lt. in Capt. Elisha Purnell's Co., August 14, 1779. (Henry C. Peden, Jr., Revolutionary Patriots of Worcester & Somerset Cos. MD, Willow Bend, Westminster, MD, 1999, p. 237)
Some Worcester County records indicate he was called "Junior", possibly to distinquish him from Benjamin Purnell d. 1768. In 1775, Edward Franklin sold 65 acres of "Assateague Beach" to Benjamin and Levin Davis. (Ruth T. Dryden, Worcester Co. MD Land Records, p. 26)
Elizabeth Marshall and Benjamin Purnell had the following children:
+ 95 i. Anne "Nancy"4 Purnell.
+ 96 ii. Mary "Polly" Marshall Purnell.
+ 97 iii. Esme Purnell was born before 1774.

+ 103 i. Ann4 James.
+ 104 ii. Rosanna "Rosey" James.
+ 105 iii. William D. James.
107 v. Margaret "Peggy" James. Margaret died after 1833. She married Nathaniel Savage in Northampton Co., VA, 1812. Nathaniel was the son of John Savage and Susan James. Nathaniel died December, 1818 in Northampton Co., VA. Under 21 in 1798. (Bill Wilkins)

(Bill Wilkins)
Robert James had the following children:
111 ii. Ainsley James. She married Michael Dennis in Northampton Co., VA, February 28, 1805.
26. John3 Marshall (Thomas John2, Patience1 "V") was born in Northampton Co., VA about 1752. John died before 1785.
He married Frances Sherwood in Caroline Co., MD, 1775. Frances was the daughter of Philip Sherwood and Elizabeth Dawson. Frances died after 1802. In 1801, John Stevens, Esq. and his wife Frances purchased a lot in East New Market from Levin Marshall (this would be Levin, brother of John Marshall, Frances' first husband) (Dorcester Co. land records 19.207, 209 researched by Vern Skinner)
In 1801, John Stevens, Esq. and his wife Frances deeded to her son Thomas Marshall their interest in "Carthegenia." (Dorchester Co. land records 19.185 researched by Vern Skinner) Notes of Jim Marshall: John and Theophilus were in possession of "Carthegenia Point" on 1783 Dorchester tax list.
Vernon Skinner shows John married Frances Sherwood, daughter of Philip and sister of Elizabeth Sherwood, who married John's brother, Theophilus.
John is listed on the 1783 Tax List. Frances married second John Stevens, Esq. on July 28, 1785, Dorchester Co., MD.
John was executor of his father's estate (Dorchester Accouts Liber 73 202 May 1, 1775)
1783 John Marshall has 6 persons in household, including Levin & Mary, siblings.
John Marshall and Frances Sherwood had the following child:
+ 115 i. Thomas4 Marshall was born about 1776.
27. Theophilus3 Marshall (Thomas John2, Patience1 "V") was born in Northampton Co., VA 1755. Theophilus died after 1808 in Dorchester Co., MD.
He married Elizabeth Sherwood before 1779. Elizabeth was the daughter of Philip Sherwood and Elizabeth Dawson. Elizabeth died after 1803. Theophilus gave a deposition in 1802 that he was aged 47. (James Marshall's notes: Dorchester Deeds HD 20, p. 113, 1802) 1778 Chancery Court June 23, order to pay and receipt by Theophious Marshall on account (MSA S 1004-12-2963 MdHR 6636-11-137/49) Theophilus and Levin were named "next of kin" in the administration of their uncle, Esme's, estate, 1784 Worcester Co., MD. He applied in March, 1787 for a license to keep an ordinary at his house in New Market. (James Marshall's notes: Dorchester Minutes, p. 108, March, 1787).
The 1783 Dorchester tax list shows that he and John were in possession of a tract of land in the Middle District called "Carthegenia Point." 1783 Dorchester Tax List shows him with "Marshalls Chance," "Marshalls Venture," 36 3/4A "Cartheginea" all in Middle District. He is shown as 'agent' for James Marshall for land in Middle District.
Theophilus was among residents of Vienna, MD who signed a petition presented in October, 1780: "situation of town and probably return of enemy crews from NY cause apprehension; aid from the state has been wanting; Tories on island gave aid to the enemy; ships in the stocks are objects of plunder; lower Dorchester, Somerset & Worcester are also threatened; when defense of the Bay is undertaken, inlets and rivers should also be defended; cannon should be sent; 6 pieces already in government hands would be a desirable addition here." (Dorcester County Maryland Genealogical Magazine, Vol. III, No. 6, March, 1984, p.17)
Theophilus appears in the 1790 census of Dorcester Co. with 2 males +16, 3 females -16, 4 females +16, and 9 slaves. There is a fifteen year difference in age between Theophilus' two known sons. It is not known if Elizabeth Sherwood is the mother of William Marshall.
Theophilus was found guilty of assault on J. Saunders in Dorchester County Court, October Term, 1792. 1793 Chancery Court, Theo. Marshall and Alexander Marshall & William Angel vs. Cuthbert Heron, Anna Heron and Harriet Heron, Ets. of Cuthbert Heron - lot in Vienna. 1794, May 2, record of birth of John, son of Theophilus & Elizabeth Marshall, Great Choptank Parish, Dorchester Co. MD.
1800 census, Dorchester Co., MD: Theo. Marshall 3M-10, 2M10-16, 1M16-26, 1M45+, 2F10-16, 1F16-26, 1F26-45, 10 slaves. In 1804, Theophilus recovered lands of Thomas Marshall (son of his brother, John), which had been sold for debt. 1805 deposition of James Condon regarding a contract between Peter Rea, deceased, and Theophilus Marshall.
The "Republican Star" reported on July 12, 1808 that their was mail at the Cambridge post office for Theophilus and William Marshall. (F. Edward Wright, MD Eastern Shore Newspaper Abstracts Vol. 2, p. 42)
No death record has been found for Theophilus and he is not found in the 1810 census. His only known children are William and John; however, his 1790 and 1800 household suggests he had other children.
Theophilus Marshall and Elizabeth Sherwood had the following children:
+ 116 i. William4 Marshall was born September 30, 1779.
117 ii. John Marshall was born in Dorchester Co., MD May 2, 1794. John is named in the will of his grandfather, Philip Sherwood in 1794. (notes of Vernon Skinner from Talbot County Distributions of Philip Sherwood's estate)
28. Levin3 Marshall (Thomas John2, Patience1 "V") was born in Northampton Co., VA about 1756. Levin died 1822 in Dorchester Co., MD.
He married three times. He married an unknown person. He married Mary (Ennalls) Hooper in Dorchester Co., MD, December 13, 1790. Mary died before 1803. It is not proved that he is the Levin who married Mary Hooper. She was the widow of Henry Hooper. A marriage record for Mary Ennalls to Henry Hooper is dated 4/14/1783. It is not clear when she died, but appears her estate was in Chancery Court in 1822, probably because of the death of Levin in that year. Her heirs are apparently children by Henry Hooper.
He married Margaret Vickers before 1803. It is NOT proved that Levin of Thomas John is the same Levin Marshall d. 1822 who married Mary Hooper and Margaret Vickers.
Levin is cited in the household of his brother, John, in 1783, for whom John is assessor and agent for Levin on land in Middle District, Dorchester Co. Tax List. Levin is listed as next of kin, along with his brother, Theophilus Marshall, at the administration of the estate of Esme Marshall, their uncle, on October 5, 1784, Worcester Co., MD. 1790 census shows a Levin Marshall, p. 57, Dorchester Co. MD 1M16+, 1F, and 10 slaves. This Levin Marshall is two pages away from Theophilus Marshall. In 1799, Levin and Henry bought a lot in East New Market. In 1799, Henry Marshall sold furniture. In 1801, John Stevens, Esq. and his wife Frances purchased a lot in East New Market from Levin Marshall (Frances Stevens was the widow of Levin's brother, John) (Dorcester Co. land records 19.207, 209 researched by Vern Skinner)
It is thought that Levin is the Levin who married December 13, 1790 Mary Hooper (Great Choptank Parish records). Mary was the widow of Henry Hooper and may be Mary Ennalls who married in 1783 Henry Hooper. A Levin Marshall's tombstone shows birth in 1756 and death in 1822 and is next to Margaret Marshall 177_-1822. It is not proved this is Levin of Thomas John. After the death of Mary (Ennalls) Hooper, it is thought he married Margaret Vickers.
1803 Anthony Taylor; son Thomas; his children: son Thomas Taylor; son John Taylor; son William Taylor; dtr. Sarah Sefton; dtr. Mary wife of Ezekiel Vickers and her dtr. Margaret Vickers wife of Levin Marshall (Dorchester Land Records 20HD 624-628; Dorchester Co Genealogical Magazine Vol III #1, May, 1983, p.5) A Levin Marshall & Margaret Thomas applied for marriage license on February 26, 1803 Dorchester Co., MD (Dorchester County Maryland Genealogical Magazine Vol VIII No 6, March, 1989, p. 4) An Elizabeth Vickers married in 1790 James Thomas.
A Levin Marshall married Rosanna Stokes April 30, 1785; he died by June 3, 1800, when "The Republican Star" reported her administration of his estate (F. Edward Wright, MD Eastern Shore Newspaper Abstracts Vol. I, p. 60). Rosanna Marshall is in the 1800 and 1810 census of Dorchester in close proximity to the Neck District Marshalls. This is not the correct Levin Marshall.
A Levin Marshall was appointed judge of Dorchester County Orphans Court as reported in the "Republican Star" on June 25, 1816. (F. Edward Wright, MD Eastern Shore Newspaper Abstracts Vol. 3, p. 48)
A Levin Marshall is shown deceased by October, 1817, Dorchester County Court, with children: Matthias Marshall, Margaret w/o Thomas Lee, Kesiah w/o William Furanden, Andrew Marshall, Henny w/o Richard Jenkins, Maria Marshall a minor, and Levin Marshall a minor.
A Levin Marshall is shown on the 1832 tax list, Cambridge District #7, Dorchester Co., MD.
This may be Mary Hooper Marshall: October Court 1822 (folio 189) Mary Marshall, deceased. Heirs: Anne wife of John Craig; Nancy Sulivane; Sally wife of John W. Henry; Henry Hooper, deceased. Dorchester marriage records show: Ann Hooper m. 5/20/1795 Joseph Sulivane. Ann Hooper m. 12/11/1809 John Craig. Sally Hooper m. 4/25/1811 John W. Henry.
Levin Marshall, deceased 1822, had daughters: Sarah R. Marshall, deceased by 1832, wife of John H. Barrow, who had a daughter, Sarah Elizabeth Barrow; and Anne Marshall wife of Thomas Hooper. (Dorchester Land Commission Cases Box 6 folio 14 1832-Dorchester County Maryland Genealogical Magazine Vol III No3, Sept, 1983, p. 15)
Levin Marshall and Margaret Vickers had the following children:
+ 118 i. Sarah R.4 Marshall was born about 1805.
119 ii. Ann Marshall was born about 1810. She married Thomas Hooper. She is called Ann in 1830 Court, wife of Thomas Hooper. There is a Dorchester marriage record for an Elizabeth Marshall's marriage in 1829 to a Thomas Hooper.
29. Henry3 Marshall (Thomas John2, Patience1 "V") was born in Northampton Co., VA about 1761. Henry died after 1802.
He married Eve Rothrock in Baltimore, MD, April 14, 1798. Eve was the daughter of Jacob Rothrock and Barbara Weller. The 1783 tax list shows no Henry Marshall. He could have been under age or deceased. However, the appearance of a Henry Marshall with Levin in 1799 certainly indicates this Henry Marshall in E. New Market is the son of Thomas John.
A Henry Marshall married Joan Mitchell September 5, 1786, Dorchester, MD.
Henry Marshall married Eve Rothrock at First Methodist Episcopal Church at Baltimore, MD.
1799, Levin and Henry bought a lot in East New Market. In 1799, Henry Marshall sold furniture. A Henry Marshall cannot be found in 1800 census. In 1802, Henry Marshall's interest in lot in East New Market was sold. (Dorchester Co. land records 19.344) In 1802, Henry Marshall deeded to his son Levin Marshall a Negro. (Dorchester land records 19HD, researched by Vern Skinner)
Henry Marshall and Eve Rothrock had the following children:
+ 124 v. Levin Rothrock Marshall was born October 10, 1800.
+ 125 vi. Sarah Weller Marshall was born 1803.
54. John4 Fisher (Maddox3, Maddox2, Patience1 "V") birth date unknown. John died after 1803 in Scott Co., KY.
John moved to Kentucky. (ref: Whitelaw)
Fayette Co., Deed Book "A" page 55 - John Fisher Senr., of Scott Co., KY., for love and affection for his children. Maddox Fisher, John Fisher, Clement Fisher, William Fisher, Thomas Fisher, Ann Huston, Susannah McCudy and Vitator G. Fisher. Dated May, 1803.
John Fisher had the following children:
+ 126 i. Maddox5 Fisher.
131 vi. Ann Fisher. She married Unknown Huston.
132 vii. Susannah Fisher. She married Unknown McCudy.
55. Thomas4 Fisher (Maddox3, Maddox2, Patience1 "V") was born in Northampton Co., VA 1737. Thomas died 1790 in Isle of Wight Co., VA.
He married Sarah Smith in Northampton Co., VA, August 1, 1764. Sarah was born about 1735. Sarah was the daughter of William Smith. Sarah was the widow of George Turner, d. 1754. (M.K.Miles) She evidently predeceased Thomas Fisher.
He made a will in Isle of Wight Co., VA, September 14, 1789. Thomas's will was probated in Isle of Wight Co., VA, January 7, 1790. Thomas went to Isle of Wight Co. VA, where he wrote his will and named his children.
Thomas Fisher and Sarah Smith had the following children:
134 i. Susannah5 Fisher. She married William Justice. Thomas Fisher named his daughter, Susannah Fisher in 1790. In a 1798 deed by the heirs of Thomas' mother, a Susannah Justice, wife of William, is shown in Whitelaw's account.
136 iii. Rosey Fisher. She married ?Unknown Henderson. In a 1798 deed showing the heirs of Thomas Fisher's mother, a Rose Henderson is named. This is probably Rose Fisher, daughter of Thomas.
137 iv. Thomas George Washington Fisher. This may be the Thomas Fisher named in the 1798 Northampton deed (Whitelaw).
+ 138 v. William Fisher.
+ 139 vi. Teackle Fisher was born about 1764.
+ 140 vii. Fairfax John Throughgood Fisher was born about 1776.
56. Ismy4 Fisher (Maddox3, Maddox2, Patience1 "V") was born in Northampton Co., VA after 1738. Ismy died 1780 in Northampton Co., VA.
He married Margaret Hall in Northampton Co., VA, April 16, 1765. Margaret was born September 28, 1735. Margaret was the daughter of Thomas Hall (Col.) and Elizabeth Scarburgh.
Upon Ismy's death, his estate was administered in Northampton Co., VA, November 14, 1780. He chose his guardian in December, 1759, so he was age 14 or older, but under age 21.
Ismy Fisher and Margaret Hall had the following children:
141 i. Thomas Hall5 Fisher. He married Prissy(wife of Thomas Fisher). (ref: Whitelaw)
Ismy Fisher had the following child:
143 iii. Maddox Fisher was born in Northampton Co., VA June, 1759. Maddox died March 31, 1834 in Accomack Co., VA. He married twice. He married Leah Corbin about 1780. Leah was born August 12, 1761. Leah was the daughter of Ralph Corbin and Rachel(wife of Ralph Corbin). Leah died before 1802. He married Leah Mears in Accomack Co., VA, January 15, 1802. Leah died July 18, 1843 in Accomack Co., VA. Maddox is named as a local heir of Thomas Dolby and would, therefore, be a descendant of Thomas Dolby's sister, Susanna. Ismy Fisher's brother, John, had a son named Maddox; it appears he stayed in Kentucky. Ismy's brother, Thomas, did not name a son Maddox in his 1789 will. It is assumed that this Maddox Fisher was the son of Ismy by a marriage previous to Margaret Hall.
Maddox served in the Revolution. He stated on August 28, 1832 that he enlisted in a company of militia commanded by Capt. William Christian in January, 1777 and remained about two years and then went to Accomack County to live and was enrolled in a militia company commanded by Capt. William Justice January 1, 1779 and continued in said company until the end of the war. He gave his birth as June, 1759. (notes of M.K. Miles)
57. Rose4 Fisher (Maddox3, Maddox2, Patience1 "V") was born in Northampton Co., VA about 1745. Rose died before October, 1799 in Worcester Co., MD.
She married George Dashiell (Jr.)(Col.) in Northampton Co., VA, August 6, 1760. George was born August 28, 1743. George was the son of George Dashiell(Col.) and Elizabeth Marshall. George died after 1799. George served in the military in Revolutionary War. George was chosen as guardian of Isaac Marshall, son of John Marshall and Mary Stringer. (Houston & Mihalyka, Colonial Residents, p. 67)
1762, George Dashiell is named next of kin in prerogative court records for the estate of Thomas Marshall (circumstantial evidence shows Thomas Marshall his uncle).
In her will dated November 3, 1793 Worcester Co., Anne Meglamery named friend, Col. George Dashiell as executor and James Fairfax Dashiell was a witness. (Ruth T. Dryden, Worcester Will Book JW, p. 14)
George's 2nd marriage to Sally Dennis is shown in Peden's Revolutionary Patriots of Worcester & Somerset. Children: James, Tubman, John and Josiah are shown in Parish birth records. Children: Robert, George, William and Fisher are shown in Peden's book.

February 7, 1778 before the Hon. Joseph Venables. (Henry C. Peden, Jr., Revolutionary Patriots of Worcester & Somerset Cos. MD, Willow Bend, Westminster, MD, 1999, p. 69) Rose witnessed the will of Thomas Marshall in 1760 and married George Dashiell that same year, at age 15. Rose and George went to Somerset Co MD.

John's heir-at-law was called Thomas 'the younger', probably to identify him from his uncle Thomas, who was John's executor. (Stratton Nottingham, Wills & Admin. Acc. Co. p.194)
John Bayley had the following child:
157 i. Thomas5 Bayley (the younger) was born in Accomack Co., VA about 1746. At the probate of John Bayley's estate in 1759, Thomas Bayley, the younger, heir at law to the testator, was cited to appear and did not, and another Thomas Bayley qualified. (Nottingham, p. 194)

His wife's brother, Americus Scarburgh, was named guardian for Edmund's son, Thomas, infant heir at law. Tabitha Gilchrist, Edmund's sister, was a witness to his will. (Stratton Nottingham, Wills & Admin. Acc. Co., Ralph Whitelaw, VA Eastern Shore, p.980). The widow, Dorothy, married John Custis and had a son, Henry Custis.
Dorothy Scarburgh named her grandson, Henry Custis, in her 1775 will. She did not name any Bayly grandchildren. With the information from the tombstone (Ralph Whitelaw, VA Eastern Shore). (notes of Cynthia McDaniel shows a daughter, Dorothy Wainhouse Bayly)

+ 163 iv. Thomas Monteagle Bayly(Col.) was born March 26, 1775.
+ 164 v. Margaret Kerr Bayly was born about 1778.
+ 165 vi. Richard Drummond Bayly was born October 12, 1780.
65. Esme4 Bayley (Mjr.) (Rose3 Fisher, Maddox2, Patience1 "V") was born December 27, 1740. Esme died November 10, 1801 in Somerset Co., MD.
He married Sinah Polk before 1773. Sinah was the daughter of David Polk and Elizabeth "Betsy" Gillis. Sinah died 1803 in Somerset Co., MD. She made a will in Somerset Co., MD, July 18, 1802. (Neil Keddie, Somerset Co. MD Wills Liber EB#5, f.50)
She named her brothers: Josiah Polk, James Polk and William Polk. She named a grandson, James Bayley, but did not give his father's name. Thomas Marshall was named guardian for Patience's grandson 1 May 1751. Will dated May 4, 1799 names wife Sinah, sons Thomas, Henry, Josiah and daughter, Peggy. Esme owned "Addition to Flower Field" between Wicomico and Quantico, "Rye Rains" in Rockawakin, "Hogsdown" and "Goodwill" and two lots in Princess Anne. (Somerset Co. MD Wills EB23, Ruth Dryden) Esme was the first Registrar of Wills in Somerset County and held that position for many years. Hayward Marshall in 1948) Joe enlisted in the Union army at age 15 and was given an honorable discharge when it was discovered he was under age. Died at Pocomoke City, Worcester Co. Md in her 67th year. Known to family as "Uncle Bob," Robert was a miller. In 1838 he deeded part of "Tarso" to Samuel D. Milbourne. (C. Hayward Marshall, Sr. & William Marshall Scott) Robert H. is shown on the 1840 census of Worcester Co., MD. Robert and wife, Elizabeth, are shown in the 1850 census of Brinkleys District, Somerset Co., MD, with Charles and Alexene. Five other persons were living in the household: Benjamin Odell, 23, George Williams, 24, and John Kenada, 23, all farmers; and Ephraim Horsey, 10, and Sarah Horsey, 14, both Black and very possibly children of Uncle Bob's neighbors, Ephraim and Zeporah Horsey.
Robert is shown in the 1860 census of Somerset County in the Dublin District.
The family Bible of Robert's son, Charles, had a piece of note paper inside with letterhead "Chosen Friends Lodge, No 100, I.O.O.F., Meets Every Tuesday Evening, Broad & Spring Garden Sts., Philadelphia, 1889. Noted on this paper was information Charles evidently wrote about his father. It reads that Robert was born "in Somerset County Md., on the old Marshall homestead, situated on the left bank of the Pocomoke River opposite Cedar Hall, on July third, 1813. Died 1886 at Crisfield, Somerset County, aged 73 years, 6 months in 1886." Robert's father had left "Tarso" to his son, Robert. (Somerset tax and will records, Clerk's Office, copied by William Marshall Scott) Robert Henry Marshall sold "Tarso" to an Isaac T. Marshall (of the Somerset family).
Note: A picture of a Robert H. Marshall and Elizabeth was found in a box marked 'family photographs' by a descendant of a Littleton Sturgis. The features of this Robert H., when compared to a photo of Charles Thomas Marshall, are similar and the Robert H. Marshall pictured was likely one and the same as Robert H., the miller. Confirmation that the photo was, indeed, that of Robert H., son of Robert Nairn Marshall, was found in a penciled entry in the family Bible of Charles W. B. Marshall, Robert Henry's son, with the notation that Alexene (Robert Henry's daughter) had married Littleton Sturgis. Alexene evidently went by the name Ella, she and married a Littleton Sturgis and the box of family photos was found in the possessions of Alexene/Ella's granddaughter.

Littleton's date of death was recorded on a funeral card. (Leslie Powell Dryden, Dryden Family and Descendants, Book I, 1992, p. 219)
Littleton was one of the first businessmen in Cape Charles, VA. He was proprietor of a small 5-room hotel located on railroad property in 1883 and later the Arlington Hotel, which opened in Cape Charles in 1886. The family Bible belonging to her brother spells her name with "i" and it has been transcribed as Alexene and also written this way in an 1894 diary. But she went by the name Ella for all her official records. It is thought the middle initial, "B" is for Birckhead, her mother's maiden name.
The family Bible of her brother also showed her date and place of birth and written in pencil after the entry "Mrs. Littleton H. Sturgis"
In her 1894 diary, Ida Lankford noted "Alexene came." It would appear it was a day visit, as Ida did not mention that her guest stayed the night; Ida was Alexene's cousin and lived at Princess Anne.
As Ella B. Sturgis, she is living at Elliott Road, Franktown, Northampton Co. VA, in 1910, with her daughter's family, Elizabeth & Frank Rolley. She is shown as mother-in-law, age 67, a widow who had 7 children and all 7 survived.
Ella's death certificate gave her name as Ella Roberta Sturgis and shows she was buried on February 9, 1919 at Fairview Cemetery, Roanoke, VA. She was living with her daughter, Ella Rolly, on Day Street, Roanoke, Virginia. A letter from Ella Sturgis dated 1919 indicates she may have had a stroke sometime shortly before her death. She signed her letters "Mama Ella" and "Mama Sturgis."
358 iii. Mary "Alice" Derickson Marshall was born in Rehobeth, Somerset Co., MD January 6, 1854. She married Howard S. Hudson about 1873. Her brother's Bible entry gives her full name, date and place of birth, followed by "Mrs. Howard S. Hudson."
In her 1894 diary, Ida Lankford records receiving a letter from Alice Hodson and also a letter from a Clara Hodson two days later. Ida would have been Alice Hodson's cousin. (marriage-notes of Matthew M. Wise)
204. Elizabeth Hester5 Marshall (Robert Nairn4, Robert Henry3, Esme2, Patience1 "V") was born in Somerset Co., MD February 27, 1820. Elizabeth died September, 1899 in Somerset Co., MD. Her body was interred in Somerset Co., MD, Riggin burying ground.
She married John W. Milbourne in Somerset Co., MD, March 18, 1845. Aunt Lizzie lived with her brother, Charles, and his wife, until her son married. (Letter from Mrs. Clarence P. Lankford, 1948) She died of complications from "the dropsy." (Jeanette Gore Scott)
Elizabeth Hester Marshall and John W. Milbourne had the following child:

He married Priscilla Virginia Porter in Somerset Co., MD, April 3, 1849. Priscilla was born in Somerset Co., MD August 7, 1831. Priscilla was the daughter of William Wrixham Porter and Sarah "Sally" Miles. Priscilla died July 31, 1880 in Somerset Co., MD. Her body was interred in Princess Anne, Somerset Co., MD, Manokin Presbyterian Church. Charles' father died when he was less than two years old. He lived with his older brother, Robert, after his mother's death when he was 15. Charles built "Holly Grove" on the southern boundary of Princess Anne, Maryland, close to and east of the railroad tracks. Charles and Priscilla are shown in the 1850 census of Brinkleys District, Somerset County, MD, age 26 and 19 respectively. His occupation is shown as 'taylor' and worth as $1,500. Living at the same household were Levin Beasham, age 12, and Adam Ballard, age 2, a Black male. Charles' name appears on a list of citizens on a petition to bring a bank to Princess Anne. Charles was elected as one of the first commissioners of Pocomoke City (originally New Town) in 1860.
Charles died when his family was young and Priscilla, age 40, with seven children to raise. Priscilla died eight years later and left "Holly Grove" to her daughter, Ida. The younger children lived with their older sister, Ida, and her husband, Fillmore, at the family home, "Holly Grove." Son, Frank, went to Kansas City to live with his older sister, Jennie Whittington, and Rush, at age 14, sold a cow to gain the money needed to go to Philadelphia and stay with his mother's family.

Joe enlisted in the Union army at age 15 and was given an honorable discharge when it was discovered he was under age. Joe and Jennie were living in Kansas City, MO and then moved to Gold Hill in Monrovia, CA. Joe was a tailor and worked in Los Angeles. (C. Hayward Marshall, Sr., Marjorie Whittington Lankford, Edna Waddell Whittington) She was called Virginia in the 1860 census. A twenty-two page, hand-written letter from Jane Frances Hayward, "Aunt Fannie," tells much of the life and times of the Whittington and Marshall families while Rush and his family were in California (written to C. Hayward Marshall in 1948)
361 ii. Ida Anna Marshall was born in Princess Anne, Somerset Co., MD September 23, 1854. Ida died December 19, 1943 in Somerset Co., MD. Mary was the daughter of Arza Harris Hayward and Ann Janette Flagg. Mary died September 29, 1926 in Washington, DC. A Christmas postcard (c. 1904) to Mr. Hayward Marshall (who would have been about age 10) from "Mith Thella" from Crisfield, MD, was addressed to 173 Hansbury Street, Germantown, Phila.
Notes from Jeanette Scott shows Mame's address as 5028 Knox Road, Germantown, PA (Philadelphia). In Mame's diary in 1948, she wrote of "letter from Doris telling of Hayward Jr.'s engagement." Rush came to Philadelphia, PA to live with his uncle, F. Wesley Porter and his wife, Ella, in a section of the city called Germantown. He first took a job at a paint shop and was later employed by John Butler at his drug store on the northwest corner of Manheim Street and Germantown Avenue. He attended Philadelphia College of Pharmacy (Class of 1880-81). After a two-year wait to attain the required age, he obtained his degree, Ph.G. In 1886, he opened his own drugstore at 16th and Race Streets.
According to a letter written to Hayward Marshall, Sr. in 1948 by Jane Phillips (Aunt Fannie), Rush had been a member of the Order of the Plumed Knights in Philadelphia and rode with the Mendicis, a bicycle club composed of doctors & druggists.
In December of 1895, due to tuberculosis, he moved the family near his sister, Jennie Whittington, in Monrovia, California. In 1898, he was a patient at the San Gabriel Sanitarium for Pulmonary Diseases. A twenty-two page, hand-written letter from Jane Frances Hayward, "Aunt Fannie," tells much of the life and times of the Whittington and Marshall families while Rush and his family were in Philadelphia and their move to California (written to C. Hayward Marshall in 1948) Two months before his death, Rush wrote a letter on San Gabriel Sanitarium stationery and mailed in a company envelope of the The Marshall Field Company in North Ontario, CA. In this letter, Rush wrote: "I wish I'd never met a Field. What involvement, if any, did Rush have with the Marshall Field Company?

They owned forest land near the factory and grew gum trees, the gum of which was used for making baskets. They made strawberry, peach, pea and tomato baskets and strawberry crates. The cleared land near the factory was owned by the Porter family. The basket factory flourished until Joe's health declined and the gum tree forest was depleted. Joe left Wellington and moved to Princess Anne and his brother moved to Pocomoke. The little town of Wellington disappeared when the post office and school were closed.
